This appeal involves two disputes arising under a prime contract (the Contract) entered into by the the Commonwealth of Pennsylvania, State Public School Building Authority (Authority) and Noble C. Quandel Company (Quandel) on June 26, 1985 to construct an Advanced Technology and Health Services Center at the Williamsport Area Community College (the Project). One dispute concerns the provision of temporary heat for the Project and the other dispute involves certain excavating and landscaping work done to prepare the site for the Project. The Board of Claims (Board) has found in favor of Quandel in both disputes and has accordingly awarded Quandel contract damages. The Authority now appeals the order of the Board.
